1. Introduction
UX Connect, LLC (“UX Connect” “we” “us”) provides a mobile application linking to this Privacy Policy (the “App”) that we use as a tool for conducting market research for which we incentivize the App user (“you” “your”). Once installed on your mobile device, the App operates in the background collecting and periodically sending to us information about third party mobile applications you use and general details about their use such as when and where you used them and for how long, and other information as further described below. We combine this usage information with other App users’ data to create aggregated business and marketing intelligence, analysis, research, and insights that we provide to our business clients in a form that cannot be linked to you or any other App user.
This Privacy Policy describes how UX Connect collects, uses, and shares personal information collected through the App and with App users in relation to the App. Personal information refers to information that identifies you or that is or can reasonably be associated with you.
2. Personal Information We Collect
We collect information you deliberately submit to us, such as information you provide to us when you register to use the App or when you complete surveys or questionnaires we provide or require in relation to your use of the App. This may include information such as your name, contact information, age, gender, employment status, and other information about you. We may collect information you voluntarily submit to us outside the App that relates to the App, such as if you email us with support or other questions about the App.
In addition to the personal information you deliberately share described above, once installed on your mobile device and registered and logged in, the App operates in the background on your device automatically collecting information, including certain of your activities on the device as further described below, and periodically transmits the information to us – typically when the device is charging and connected to wifi. This information may include general technical information about your device such as your device type, operating system and version, and other device specifications, and a device identifier. The App also collects certain usage information about your device, including:
- Which applications you have installed on your device and the date, time, and duration of their use as well as the location of the device when an application is opened;
- Battery information and connectivity of your device, such as what type of cellular network it is using and whether it is using wifi or bluetooth (but not information transmitted through the networks); and
- Location of your device via GPS (if your device is so equipped and depending on your settings).
Generally, this information could identify or be associated with you and so is personal information.
The App does not collect the content of your phone calls (audio or otherwise), emails, text messages, or other communications, or with whom you are communicating. It does not collect the files or content you store, enter, or receive on or through your device, such as your contacts, photos, calendar information, passwords, or files, or your web browsing or third party application search history. For example, if you use your device to send a message through a social media application on your device, the App does not collect the content or recipient of your message or any other specific activities you engage in while using the social media application. If you use a mobile browser on your device, the App does not collect the websites you navigate to, your communications through, or your other activity within the browser application. Rather, we only collect the fact that you are using these applications and the other details about that use described above, such as the time, duration, and location of the application’s use.
3. Purposes of Using Personal Information
Depending on the circumstances, we may use your personal information to:
- Register your installation and use of the App, maintain your account, and perform our obligations in relation to the App, such as determining and issuing you agreed incentives for your use of the App;
- Collect the information described above for purposes of combining it with other App users’ information into aggregated business and marketing intelligence that we provide to our business clients as part of our business offerings;
- Operate and improve the App and our business generally;
- Communicate with you about your use of the App including sending you information, requesting your feedback, answering your questions, providing you support, and notifying you of changes to our policies and terms;
- Analyze your use of the App to maintain, improve, and troubleshoot the operation of the App;
- Detect, investigate, and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal; and
- Comply with legal obligations and enforce our legal agreements including those governing your use of the App; and
- Engage in the activities described in this Privacy Policy.
We do not use the personal information we collect through the App to target advertising specifically to you or to enable others to do so. The personal information is collected solely to generate aggregated research, insights, and information that cannot be associated with you or any specific individual and as otherwise described in this Privacy Policy.
4. When We Disclose Personal Information to Third Parties
As indicated above, we do not share your personal information with unaffiliated third parties for their own marketing, tracking, or other purposes. We do not sell or lease your personal information (except as part of a sale or reorganization of our company as described below).
We may disclose personal information we collect to third parties as follows:
- With our affiliated organizations (for example, our parent company, or companies under common control with us);
- With our vendors involved in hosting the App and the application data within it, providing support or analytics services, monitoring and ensuring security, and otherwise supporting our operation of the App;
- With law enforcement agencies, government bodies, regulatory organizations, courts, or other public authorities if we agree to comply with their requests;
- To satisfy any applicable law, or other legal or regulatory requirement;
- With a third party with which we are engaged in an acquisition, merger, asset sale, or other similar business transfer that involves a sale or transfer of personal information we maintain; and
- When you direct or specifically consent to the disclosure.
5. Third Party Links
The App may contain links to Internet sites or third-party applications operated by other companies that we don’t own or control. For example, we may use third party companies like SurveyMonkey to deliver and collect surveys through the App on our behalf and that may include third party links to the provider’s or others sites. UX Connect cannot be responsible for the privacy practices of websites or other services operated by third parties. Once you leave the App via such a link or access a third-party application or widget, you should review the applicable privacy policy of that third party to determine how they will handle any personal information they collect from you.
6. Location Services
Depending on your device settings and capabilities, the App may, as indicated above, collect and provide us with your general or precise location (through the location of your device) at the time you open applications on your device. In most devices, you may enable or disable such location collection (sometimes referred to in the device as “Location Services”) at any time through your device’s settings menu. If you choose to opt out of or disable any location collection on your device by the App, the App will not collect your location.
7. Cookies
We collect information through the use of “cookies”, tokens, and other technologies that may involve storing small files on your device. These technologies allow us to do a number of things such as remember your preferences, allow certain App features to function, and analyze activity on our App and related websites in an aggregated manner. These technologies do not themselves store information that identifies you, but they are often used in a manner such that they can be associated with you.
Here are the purposes for which we may use these technologies:
- Strictly Necessary - these are required by the App to perform certain functions such as allowing you to login into the App;
- Functional – these help to improve your experience by doing things like remembering certain preferences you have set or optimizing the App for your device; and
- Analytic – these are used to analyze, in an aggregated manner, the way the App is used so that we can better troubleshoot and improve the App and our offerings.
These technologies may be set by us or by third parties we use for certain functions. Most Internet browser settings will allow you to accept, reject, delete, and otherwise manage cookies set when using that browser. You can find more information about this at https://allaboutcookies.org/. Blocking our strictly necessary cookies will prevent certain functions of our App from working properly or at all. We analyze usage of the App using Google Analytics. In addition to managing Google Analytics by managing its cookies, you can deactivate Google Analytics by using a browser plug-in found here.
8. How Do I Manage My Personal Information?
Through your account profile screen in the App, you may review, update, and delete your personal information shown there, however, we minimally need your name and email address in your profile in order for you to earn rewards and incentives through the App. To request access to or correction or deletion of your personal information that you cannot manage through your account profile or to request that we delete your account, you can contact us with the request at our contact information below. When personal information is deleted from your account (or your account is deleted entirely), the personal information is permanently deleted from the App’s active user database. However, the information will remain in backups of the database until cycled out in accordance with our backup retention practices. You should be aware that traces of data can be recorded in multiple places in an information technology system and therefore it may not be technologically possible to remove each and every record of the information you have provided to us from our servers. If you would like to stop the collection of personal information by the App on your device then you may do so by uninstalling the App from your device or logging out of the App.
9. How Secure Is My Personal Information?
We use reasonable administrative, technical, personnel, and physical measures to safeguard your personal information against loss, theft, or unauthorized use, disclosure, or modification. However, you should be aware that, particularly with Internet-based technology such as the App, there is always some risk of unauthorized access or loss of personal information stored in or transmitted to and from the App.
10. Retention of Personal Information.
We typically will retain the personal information we collect for up to five years from its original time of collection or closing of your account during which time we may use it for the purposes described in this Privacy Policy, such as to generate new types of aggregated data. However, we may delete it sooner, including where we honor your request to delete it. You should not rely on the App as a repository of your personal information.
11. Children Under the Age of 18
The App is not intended for use by children. If you are under 18, do not use or provide any information to this App or through any of its features. If we learn we have collected or received personal information from someone under 18, we will delete that information. 12. United States-Based
The App is hosted and operated in and is intended for use within the United States. If you are located outside of the United States, please be aware that the information submitted to us in relation to the App will be transferred to and processed in the United States. We do not undertake to comply with privacy or data protection laws of other countries.
13. Changes to Our Privacy Policy
UX Connect may change this Privacy Policy at any time. Any changes will become effective upon the date of our posting of the revised Privacy Policy here as indicated by the “last updated” date above. Depending on the extent of the change, we may notify you of the update via email and/or through the App.
